These Terms of Service (the “Terms”) govern your access to and use of GagTheGuy.com and any related pages (together, the “Site”). In these Terms, “GagTheGuy”, “we”, “us” and “our” refer to the operator of the Site, and “you” refers to any person who accesses the Site.

1.Acceptance of These Terms

By accessing or using the Site in any way, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy, our DMCA / Copyright Policy and our 18 U.S.C. 2257 Statement, each of which forms part of these Terms. If you do not agree, you must not use the Site.

You must be legally capable of entering into a binding agreement to use the Site. If you use the Site on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.

2.Age Requirement and Consent to Adult Material

By entering the Site, you represent and warrant that:

• you are at least 18 years old and have reached the age of majority in every jurisdiction from which you access the Site (in some places this is 19, 20 or 21);
• you are voluntarily choosing to view sexually themed adult material for your own personal use, and you are not offended by depictions of adult bondage, restraint, gagging and related fetish themes;
• viewing, possessing and downloading such material is lawful in your community and jurisdiction, and you are solely responsible for complying with your local laws;

Any age confirmation on the Site is a condition of entry, not a verification of age. Accessing the Site while under age, or by giving a false confirmation, is a breach of these Terms. We may restrict access from any jurisdiction, and may introduce age-assurance measures where the law requires them.

3.What the Site Is

GagTheGuy is a discovery and entertainment site for adults interested in male bondage and gag content. The Site features promotional material supplied or made available by third parties, including:

• clips, previews and trailers from third-party studios, producers and creators;
• promotional images from third-party studios; and
• bondage comics and illustrations created by third-party artists.

We do not produce any of the content shown on the Site. Material is created by independent studios, producers, creators and artists who are solely responsible for their own work, including the consent, age verification and record keeping for any persons depicted. The material we promote is made available through third-party platforms that review content under their own policies.

The Site offers no user accounts, no purchases, no comments, no uploads and no newsletter. You browse the Site and may follow links to third-party websites. Any purchase, subscription or account you create happens on those third-party websites and is governed by their own terms and policies, not ours.

4.Zero Tolerance and Content Standards

We will not knowingly feature material that is illegal, that depicts real (as opposed to staged) violence or harm, or that the depicted persons have not agreed to have distributed. If you believe any material on the Site breaches these standards, please report it as described in Section 5.

5.Reporting Content and Removal Requests

Anyone can report material on the Site. You do not need to be the person depicted or the rights holder. To make a report, email webmaster@gagthegirl.net with the subject line “Content Report” and include:

1. the full URL of each page and, where possible, a description of the specific image, clip or comic concerned;
2. the reason for your report (for example: suspected minor, lack of consent, a depicted person withdrawing permission, privacy concern, or illegal content); and
3. an email address where we can reach you if we need more information. Anonymous reports about suspected minors or non-consensual material will still be acted on.

If you are a person depicted

If you appear in material on the Site and want it removed, write to us with the subject line “Removal Request”. We may ask for limited information to confirm that the request relates to you, but we will only ask for what is reasonably necessary and will treat your request confidentially. You do not need to explain why you want the material removed.

What we do

• We review every report promptly. Reports about suspected minors or non-consensual material are given priority, and we disable access to the material while we investigate.
• Where a report is substantiated, or where a person depicted asks for removal, we remove the material and stop promoting it.
• Where material is hosted or sold by a third-party platform, we will also recommend that you contact that platform, which controls the original copy. We may notify the platform ourselves.

Copyright complaints should follow our DMCA / Copyright Policy.

6.Fictional and Consensual Nature of the Content

Bondage, restraint and gag material featured on the Site is staged adult roleplay. It is created by third-party producers to depict fantasy scenarios between consenting adults. Scenarios that appear to show capture, struggle, reluctance or distress are performances and are not depictions of real events, real coercion or real harm. Nothing on the Site is intended to promote, encourage or glorify non-consensual acts, violence or abuse.

The comics and illustrations shown on the Site are fictional drawn works created by third-party artists. All characters in them are fictional adults aged 18 or older, regardless of how they may be drawn or described. They do not depict real persons or real events.

Bondage and restraint carry real physical risks, including risks to breathing and circulation. The content on the Site is entertainment, not instruction. Do not attempt to recreate anything you see without proper knowledge, the informed consent of everyone involved, and appropriate safety precautions. We accept no responsibility for any activity you undertake.

7.Permitted Use and Prohibited Conduct

We grant you a limited, personal, non-exclusive, non-transferable and revocable permission to view the Site in a standard web browser for your own private, non-commercial use, subject to these Terms. Everything not expressly permitted is prohibited. In particular, you must not:

• allow, help or enable any minor to access the Site, or display the Site to anyone who has not consented to view adult material;
• scrape, crawl, spider, harvest or mass-download any part of the Site or its content, whether manually or by automated means (including bots, scripts, AI or machine-learning data collection tools), except for search-engine indexing that complies with our robots.txt instructions;
• frame, mirror, hotlink or embed the Site or any of its content on another website or service, or present it in a way that suggests it belongs to anyone other than its owner;
• copy, reproduce, redistribute, sell, resell, license, sublicense, rent or otherwise commercially exploit the Site or any content on it;
• remove, alter or obscure any copyright notice, watermark, trademark, affiliate parameter or other identifying information;
• interfere with affiliate links or tracking, including by generating artificial clicks, using click-fraud techniques, or substituting your own referral codes;
• attempt to gain unauthorised access to the Site, its servers or any connected systems; probe, scan or test their vulnerability; or introduce malware, viruses or other harmful code;
• overload or disrupt the Site, including through denial-of-service attacks or excessive automated requests;
• use the Site in connection with any unlawful purpose, including the harassment, stalking, identification or exposure of any person depicted; or
• circumvent any geographic restriction, age-assurance measure or other access control we put in place.

8.Third-Party Links and Affiliate Disclosure

The Site links to websites, platforms and services that we do not own or control, including clip stores, studio websites and content platforms. When you click an outbound link you leave the Site, and your use of the third-party site is governed by its own terms, privacy policy and age requirements.

We do not endorse, and are not responsible or liable for, any third-party website, its content, products, services, prices, availability, billing, refunds, privacy practices or security. Any transaction you make on a third-party site is solely between you and that third party. Please direct any questions or complaints about a purchase to the seller concerned.

Information on the Site about third-party content (such as titles, descriptions, studios, prices or availability) may be supplied by third parties, may change without notice and may not always be accurate. Always check the details on the third-party site before you buy.

9.Intellectual Property and Trademarks

The clips, trailers, images, comics and other material featured on the Site, and all related copyrights, are owned by their respective studios, producers, creators, artists or licensors and are used for promotional purposes. Studio names, logos, product names and trademarks displayed on the Site belong to their respective owners. Their use on the Site does not imply any affiliation with, sponsorship by or endorsement from those owners, unless expressly stated.

The GagTheGuy name and logo, the design, layout and organisation of the Site, and any original text we write (such as descriptions, reviews and editorial content) are owned by or licensed to us and are protected by copyright, trademark and other intellectual property laws. You may not use them without our prior written permission.

10.Parental Controls

We support efforts to keep minors away from adult material. The Site is labelled with the RTA (“Restricted To Adults”) label, which allows parental-control software to recognise and block it. The label is implemented as a meta tag in the following form:

If you share a device or network with minors, we strongly recommend that you use parental-control or content-filtering tools on your devices, browser, router or internet connection, keep your devices protected with a password, and clear your browsing history and cookies after visiting adult sites. Parents and guardians are responsible for supervising the online activity of the minors in their care.

11.Disclaimer of Warranties

The Site and all content are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment.

12.Limitation of Liability

To the fullest extent permitted by law, GagTheGuy and its operators, affiliates, contractors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, reputation or privacy, arising out of or relating to your use of, or inability to use, the Site, any content on it, or any third-party website, product or service, whether based on contract, tort (including negligence), strict liability or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to the Site or these Terms will not exceed one hundred US dollars (USD 100).

Because the Site is free to use and you make no payment to us, these limitations reflect a reasonable allocation of risk and are a fundamental part of the basis on which we make the Site available. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection laws that apply to you.

13.Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless GagTheGuy and its operators, affiliates, contractors and licensors from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your access to or use of the Site; (b) your breach of these Terms; (c) your violation of any law or the rights of any third party; or (d) any access to the Site by a minor or other person through your device, network or credentials. We may assume the exclusive defence and control of any matter subject to indemnification by you, and you will cooperate with our defence of it.

14.Termination and Access Restriction

We may, at any time and without notice or liability, suspend, restrict or terminate your access to all or part of the Site, block IP addresses, devices or regions, or discontinue the Site, for any reason, including if we believe you have breached these Terms or that your use creates legal risk for us or others. Sections of these Terms that by their nature should survive termination will survive, including those on intellectual property, disclaimers, limitation of liability, indemnification and disputes.

15.Governing Law and Disputes

These Terms, and any dispute or claim arising out of or relating to them or the Site (including non-contractual disputes), are governed by the laws of the jurisdiction in which the operator of the Site is established, without regard to its conflict-of-law rules. The courts of that jurisdiction have exclusive jurisdiction over any such dispute, and you consent to their jurisdiction and venue.

Before bringing any formal claim, you agree to first contact us at webmaster@gagthegirl.net and to try in good faith to resolve the dispute informally for at least 30 days.

To the extent permitted by law: (a) any claim must be brought within one (1) year after the cause of action arises, or it is permanently barred; and (b) claims may be brought only in your individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding.

If you are a consumer, nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence, or of any right you have under that law to bring proceedings in the courts where you live.

16.Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to the Site or to the law. The updated Terms will be posted on this page with a new “Last updated” date and take effect when posted. Your continued use of the Site after that date means you accept the updated Terms. If you do not agree, you must stop using the Site.

17.Severability, Entire Agreement and General Terms

• Severability. If any provision of these Terms is found invalid, illegal or unenforceable, it will be enforced to the maximum extent permissible or modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• Entire agreement. These Terms, together with the policies referred to in them, are the entire agreement between you and us regarding the Site and supersede any prior understandings.
• No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign or transfer your rights under these Terms. We may assign ours at any time without restriction.
• No relationship. Nothing in these Terms creates any partnership, joint venture, employment or agency relationship between you and us.
• Language and headings. These Terms are written in English, which prevails over any translation. Headings are for convenience only.
