This Privacy Policy explains what information GagTheGuy (“we”, “us”, “our”) collects when you visit GagTheGuy.com (the “Site”), why we collect it, who we share it with, and the choices and rights you have. It also serves as our Cookie Policy.
- There are no accounts, purchases, comments, uploads or newsletters on the Site, so we do not ask for your name, address or payment details.
- We collect technical data (such as IP address, device and browser information, and pages viewed) through server logs, Google Analytics and affiliate tracking, including cookies.
- When you click an outbound link, the third-party site handles any data you give it under its own privacy policy.
- We do not sell your personal information for money. You can opt out of analytics and affiliate cookies at any time.
1.Who We Are and Scope
The operator of the Site is the “controller” (or “business”) responsible for personal information processed through the Site. You can contact us about anything in this policy at webmaster@gagthegirl.net.
This policy applies to information processed when you visit the Site and when you contact us by email. It does not apply to third-party websites you reach through links on the Site, including clip stores and studio websites. Those sites have their own privacy policies, which we encourage you to read.
2.Information We Collect
Because the Site has no accounts or forms, we collect only a limited amount of information, almost all of it automatically.
Server and security logs
Like most websites, our hosting servers automatically record technical information when you request a page: your IP address, the date and time of the request, the page or file requested, the referring URL, your browser type and version, operating system, and HTTP status and error codes.
Device and usage information
Through cookies and similar technologies (see Section 5), we and our analytics and affiliate partners may collect: device type, screen size, browser and language settings; approximate location (country, region or city) derived from your IP address; pages visited, time spent, scrolling and navigation within the Site; links clicked, including outbound and affiliate links; and online identifiers such as cookie IDs.
Affiliate tracking information
When you click an affiliate link, the affiliate program or partner site records that the click came from the Site, usually by placing a cookie or adding a referral parameter to the link. If you later buy or subscribe on the partner site, the partner may tell us that a referred sale or sign-up occurred, so that we can be paid a commission. We generally receive aggregated or transaction-level reports (such as the date, product and commission amount). We do not receive your payment details, and we do not ask partners for your name or contact details.
Information you send us
If you email us (for example with a question, a content report, a removal request, a copyright notice or a privacy request), we receive your email address, the content of your message, any attachments and any other details you choose to include.
Information we do not collect
We do not knowingly collect information from anyone under 18. We do not ask for, and ask you not to send us, sensitive information about you (such as health information or information about your sex life or sexual orientation). Please note, however, that the fact that a device visited an adult website may itself be considered sensitive in some jurisdictions. We treat all visit data with that in mind.
3.How We Use Information and Our Legal Bases
We use information only for the purposes below. Where the GDPR, the UK GDPR or similar laws apply, we rely on the legal bases shown.
| Purpose | Information used | Legal basis |
|---|---|---|
| Delivering the Site, displaying pages correctly and remembering basic settings (such as your age confirmation) | Server logs, device information, strictly necessary cookies | Legitimate interests in operating the Site; strictly necessary storage does not require consent |
| Keeping the Site secure, preventing abuse, scraping, fraud and attacks, and enforcing our Terms | Server and security logs, IP address | Legitimate interests in security; legal obligations where applicable |
| Measuring audience and improving the Site through Google Analytics | Analytics cookies, usage and device information, approximate location | Consent, where required by law; otherwise legitimate interests in understanding how the Site is used |
| Tracking referrals to partner sites so that we can earn affiliate commissions and detect affiliate fraud | Affiliate cookies and referral parameters, click data, partner reports | Consent, where required by law; otherwise legitimate interests in funding the Site |
| Responding to your emails, content reports, removal requests, copyright notices and privacy requests | Your email address and message content | Legitimate interests in responding to you; legal obligations (for example under copyright and data protection law) |
| Complying with the law, responding to lawful requests from authorities, and establishing, exercising or defending legal claims | Any of the above, as necessary | Legal obligations; legitimate interests in protecting our rights |
Where we rely on legitimate interests, we have weighed those interests against your rights and concluded that the processing is limited, expected and proportionate. You can object to it at any time (see Section 11). We do not use your information for automated decision-making that produces legal or similarly significant effects on you.
4.Sources of Information
We collect information directly from your browser or device when you visit the Site, from you when you email us, and from our analytics provider and affiliate partners (usually in aggregated or reporting form).
5.Cookies and Similar Technologies
Cookies are small text files placed on your device by a website. Similar technologies include pixels, tags, local storage and link parameters. We use them in the following categories:
| Category | Purpose | Set by |
|---|---|---|
| Strictly necessary | Making the Site work, keeping it secure, and remembering choices such as your age confirmation and cookie preferences | Us and our hosting and security providers |
| Analytics | Counting visits and traffic sources, and understanding which pages and links are used, so we can improve the Site | Google (Google Analytics) |
| Affiliate and referral | Recording that you reached a partner site through the Site, so that the partner can credit us for any resulting sale or sign-up | Affiliate programs and partner sites, usually after you click an outbound link |
Google Analytics typically sets first-party cookies whose names begin with _ga, which by default can last up to two years. Affiliate cookies are usually set on the partner’s own domain when you click through, and their duration is set by the partner (often between 30 days and one year).
Your cookie choices
- Consent. Where the law requires your consent for non-essential cookies (for example in the EU, the EEA and the UK), we only use analytics and affiliate cookies after you have agreed. You can withdraw or change your consent at any time through any cookie settings link on the Site or by deleting cookies in your browser.
- Browser settings. Most browsers let you view, block and delete cookies, and block third-party cookies. Blocking strictly necessary cookies may stop parts of the Site from working.
- Google Analytics opt-out. You can stop Google Analytics from collecting data about your visits by installing the Google Analytics Opt-out Browser Add-on.
- Private browsing. Using a private or incognito window means cookies are deleted when you close it.
Blocking or deleting affiliate cookies does not prevent you from buying on a partner site. It only means the partner may not credit the referral to us.
6.Google Analytics
We use Google Analytics, a web analytics service provided by Google, to understand how visitors use the Site. Google Analytics uses cookies and similar technologies to collect information such as pages viewed, time on site, device and browser details, approximate location and how you arrived at the Site. According to Google, Google Analytics 4 does not log or store IP addresses, and approximate location is derived from the IP address before it is discarded.
We use Google Analytics reports in aggregated form. We do not use Google Analytics to identify individual visitors, and we do not combine analytics data with any information that would identify you by name.
Google processes this information under its own terms and policies. You can learn more at How Google uses information from sites or apps that use its services and in Google’s Privacy Policy. To opt out, use the Google Analytics Opt-out Browser Add-on.
7.Who We Share Information With
We do not sell your personal information for money, and we do not share your information with anyone except:
- Service providers who help us run the Site, such as hosting, content delivery, security and email providers. They process information on our behalf and under our instructions.
- Google, as our analytics provider, as described in Section 6.
- Affiliate programs and partner sites, which receive click and referral information when you follow an affiliate link, and which may share sales or sign-up reports with us. Once you are on a partner site, that partner is responsible for the data it collects from you.
- Rights holders and platforms, where necessary to process a copyright notice, counter-notice or content report. For example, a counter-notice is forwarded to the person who submitted the original notice, as required by law.
- Authorities and others where we believe disclosure is required by law, court order or other legal process, or is necessary to protect the rights, safety or property of any person, to investigate suspected child sexual abuse material or other illegal content, or to establish, exercise or defend legal claims.
- Successors, if the Site is sold, transferred or reorganised, in which case information may be transferred subject to this policy.
“Selling” and “sharing” under US state laws
Some US state privacy laws define “selling”, “sharing” or “targeted advertising” broadly enough that the use of third-party analytics or affiliate cookies may fall within those terms, even though no money changes hands for your data. If that applies to you, you can opt out at any time by blocking or deleting these cookies, by using the Google Analytics Opt-out Browser Add-on, by enabling an opt-out preference signal such as Global Privacy Control, or by emailing us. Where applicable law requires it, we treat a recognised opt-out preference signal as a valid request to opt out for that browser.
8.International Data Transfers
The Site serves a worldwide audience, and our service providers, Google and our affiliate partners may process information in countries other than your own, including the United States. These countries may have data protection laws that differ from those where you live.
Where we transfer personal information out of the EU, the EEA, the UK or Switzerland, we rely on an appropriate safeguard, such as an adequacy decision (including, where applicable, the EU-US Data Privacy Framework and its UK and Swiss extensions), or standard contractual clauses approved by the relevant authorities, together with any supplementary measures required. You can ask us for more information about these safeguards by email.
9.How Long We Keep Information
- Server and security logs are kept for a limited period needed for security and troubleshooting, and are then deleted or anonymised, unless we need them longer to investigate a specific incident.
- Google Analytics data is retained according to the retention setting configured in Google Analytics (Google Analytics 4 allows a maximum of 14 months for user-level and event-level data). Aggregated reports that do not identify anyone may be kept longer.
- Cookies remain on your device for the periods described in Section 5, unless you delete them earlier.
- Affiliate reports are kept for as long as needed for accounting, tax and commission-dispute purposes.
- Emails and requests are kept for as long as needed to deal with them and any follow-up, and for longer only where we need a record to meet legal obligations or to establish, exercise or defend legal claims (for example, records of copyright notices and removal requests).
10.Security
We use reasonable technical and organisational measures to protect information, including encrypted connections (HTTPS), access restrictions and keeping software up to date. No website or internet transmission is completely secure, however, and we cannot guarantee absolute security. If we become aware of a personal data breach that affects you, we will notify you and the relevant authorities where the law requires us to.
11.Your Privacy Rights
Depending on where you live, you may have some or all of the following rights. We respect these rights for all visitors where reasonably possible, wherever you live.
EU, EEA, UK and Swiss residents (GDPR, UK GDPR and similar laws)
- Access: to know whether we process your personal data and to receive a copy.
- Rectification: to correct inaccurate data.
- Erasure: to have your data deleted in certain circumstances.
- Restriction: to limit how we use your data in certain circumstances.
- Objection: to object to processing based on legitimate interests, including profiling.
- Portability: to receive data you provided to us in a structured, machine-readable format.
- Withdraw consent: at any time, without affecting processing that took place before you withdrew it.
- Complain: to lodge a complaint with the data protection supervisory authority where you live or work, or where you believe a breach occurred. We would appreciate the chance to address your concerns first.
US residents (California CCPA/CPRA and other state privacy laws)
In the past 12 months, we have collected the following categories of personal information: identifiers (such as IP address and cookie IDs); internet or other electronic network activity (such as pages viewed and links clicked); approximate geolocation derived from IP address; and, if you email us, the contact details and content you provide. We collect them from the sources and for the purposes described in this policy, and we disclose them to the categories of recipients described in Section 7. We do not use or disclose sensitive personal information for purposes that would give rise to a right to limit its use.
Subject to applicable law, you have the right to:
- know and access the personal information we have collected about you, including the categories, sources, purposes and recipients;
- delete personal information we have collected from you;
- correct inaccurate personal information;
- opt out of the “sale” or “sharing” of personal information and of targeted advertising (see Section 7 and Section 13);
- appeal our decision on your request, by replying to our response with the word “Appeal”; and
- not be discriminated against for exercising any of these rights.
Other jurisdictions
Residents of other countries and regions, including Canada, Brazil, Switzerland, Australia, Japan, South Korea, South Africa and others, may have similar rights under their local laws, such as rights of access, correction, deletion and objection, and the right to complain to a local regulator. We will honour these rights as required by the law that applies to you.
12.How to Exercise Your Rights
Email webmaster@gagthegirl.net with the subject line “Privacy Request”, and tell us which right you want to exercise and where you live. You may use an authorised agent, who must provide proof of their authority.
Because the Site has no accounts and we do not link visit data to names, we can often only find data relating to you if you give us identifiers we hold, such as the IP address you used and the approximate date and time of your visit, or the value of your Google Analytics cookie (beginning _ga). We may ask for this information to verify your request and to make sure we do not disclose someone else’s data. We will not ask for more information than is reasonably necessary. If we cannot link any data to you, we will tell you.
We will respond within the time required by applicable law, normally within one month (GDPR and UK GDPR) or 45 days (US state laws). These periods can be extended where the law allows. Requests are free of charge, unless they are manifestly unfounded or excessive.
For data held by Google or by a partner site, you can also contact them directly, since they control that data.
13.Do Not Track and Opt-Out Signals
There is no common industry standard for responding to “Do Not Track” (DNT) browser signals, so the Site does not currently change its behaviour in response to DNT alone. Where applicable law requires it, we treat a recognised opt-out preference signal, such as Global Privacy Control, as a request to opt out of the sale or sharing of personal information for that browser.
Whatever your location, you can limit tracking at any time by:
- installing the Google Analytics Opt-out Browser Add-on;
- blocking or deleting third-party and analytics cookies in your browser settings;
- using your browser’s private or incognito mode, or a privacy-focused browser or extension; or
- withdrawing consent through any cookie settings on the Site.
14.Children
The Site is strictly for adults aged 18 or over, or the age of majority where they live, if higher. It is not directed at children, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has accessed the Site or sent us personal information, contact us at webmaster@gagthegirl.net and we will delete that information.
We strongly recommend that parents and guardians use parental-control tools. The Site carries the RTA (“Restricted To Adults”) label to help those tools block it. See our Terms of Service for more information.
15.Third-Party Websites
The Site links to third-party websites, including clip stores, studio sites and affiliate partners. When you click an outbound link, the third party may collect information from you directly, including any account, payment or contact details you provide when buying or subscribing. We are not responsible for the privacy practices of those websites. Please read their privacy policies before giving them any information.
16.Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes to the Site, our partners or the law. The updated version will be posted on this page with a new “Last updated” date. If we make significant changes, we will take reasonable steps to bring them to your attention, for example with a notice on the Site. Where the law requires your consent to a change, we will ask for it.
17.Contact Us
