GagTheGuy (“we”, “us”) respects the intellectual property rights of studios, producers, creators and artists, and expects visitors and partners to do the same. This policy explains how to notify us of alleged copyright infringement on GagTheGuy.com (the “Site”) under the US Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and comparable laws elsewhere, and how to respond if material you provided has been removed.
Send all copyright notices and counter-notices to webmaster@gagthegirl.net with the subject line “DMCA Notice” or “DMCA Counter-Notice”. We do not accept notices by post or telephone.
1.Our Policy
The Site features promotional clips, trailers, images and comics from third-party studios, producers, creators and artists. Some of this material is stored on our servers, and some is embedded from or linked to third-party platforms. We do not produce any of it.
It is our policy to respond expeditiously to valid notices of alleged infringement by removing or disabling access to the material concerned, and to terminate or restrict, in appropriate circumstances, the use of sources that repeatedly infringe. We do this whether the material is stored on the Site or reached through a link on it.
2.Designated Copyright Contact
Our designated contact for notices of claimed infringement under 17 U.S.C. § 512(c)(2) can be reached by email only at:
Copyright / DMCA Agent, GagTheGuy
Email: webmaster@gagthegirl.net
This address is for copyright matters. For other content concerns, including reports of suspected minors, non-consensual material, or a request from a person depicted, see the reporting procedure in our Terms of Service. These reports do not need to meet DMCA formalities and are given priority.
3.How to Submit a Takedown Notice
To be effective under 17 U.S.C. § 512(c)(3), your notice must be in writing and must include all of the following:
- A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed. A typed full name at the end of an email is acceptable as an electronic signature.
- Identification of the copyrighted work claimed to have been infringed or, if multiple works are covered by a single notice, a representative list of those works.
- Identification of the material that is claimed to be infringing, or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, with information reasonably sufficient to allow us to locate it. The full URL of each page or file on the Site is the best way to do this.
- Information reasonably sufficient to allow us to contact you, such as your name, postal address, telephone number and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
Before you send a notice, please consider whether the use may be licensed or authorised. Much of the material on the Site is promotional material made available by studios and platforms for affiliate use. If you are unsure, contact us first and we will try to resolve the matter informally.

4.What Happens After We Receive a Notice
- We review each notice promptly and, if it is valid, remove or disable access to the identified material expeditiously.
- Where we can identify and contact the source of the material, we take reasonable steps to notify them of the removal and of their right to send a counter-notice.
- If the material is embedded from or hosted by a third-party platform, we remove the embed or link from the Site. Because the original copy remains under that platform’s control, we recommend that you also send a notice to the platform concerned.
- We may share your notice, including your name and contact details, with the source of the material, the platform concerned, or with services that collect and publish takedown notices for transparency, with personal contact details removed where appropriate.
5.Counter-Notice Procedure
If material you provided or control was removed or disabled and you believe this happened because of a mistake or misidentification, you may send us a counter-notice. To be effective under 17 U.S.C. § 512(g)(3), it must be in writing and include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which it appeared before it was removed or disabled.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original notice or an agent of that person.
When we receive a valid counter-notice, we will promptly forward a copy to the person who submitted the original notice and inform them that we will restore the removed material, or cease disabling access to it, in 10 business days. We will restore the material not less than 10 and not more than 14 business days after receiving the counter-notice, unless we first receive notice from the original complainant that they have filed an action seeking a court order to restrain the alleged infringement.
Please be aware that your counter-notice, including your personal contact details, will be forwarded to the original complainant. We may decline to restore material where we have separate grounds to keep it removed, for example under our content standards.
6.Misrepresentation Warning
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, the copyright owner or its licensee, or by us. If you are not sure whether material infringes your rights, please consult a lawyer before sending a notice or counter-notice.
7.Repeat Infringer Policy
The Site has no user accounts or uploads. Material comes from third-party sources, such as studios, producers, creators, artists, platforms and affiliate programs. In accordance with 17 U.S.C. § 512(i), we maintain the following policy:
- We keep a record of valid notices received and of the source of each item removed.
- A source that is the subject of repeated valid notices that have not been successfully countered will be treated as a repeat infringer. In appropriate circumstances, we will stop featuring material from that source, remove existing material from it, and stop linking to it.
- We may act against a source after fewer notices, or after a single notice, where the infringement is clear, deliberate or serious.
- We may also restrict access to the Site for any person or network that we determine is involved in repeated infringement, such as unauthorised copying or redistribution of Site content.
8.Rights Holders Outside the United States
We welcome notices from rights holders anywhere in the world. You do not need to rely on US law. We will also consider notices made under the copyright, notice-and-action or intermediary-liability laws of your own country, including those of the European Union and the United Kingdom.
To help us act quickly, please include the same information listed in Section 3: identification of your work and of the material on the Site (with URLs), your contact details, a statement of your good faith belief that the use is not authorised, and a statement that your notice is accurate and that you are the rights holder or are authorised to act for them. Notices may be written in English or accompanied by an English translation.
Notices about other rights, such as trademarks, image or personality rights, or privacy, can be sent to the same address. Please explain the right concerned and why you believe it is being infringed.
9.Requests From Persons Depicted
If you appear in material on the Site and want it removed, you do not need to own the copyright or send a formal DMCA notice. Email webmaster@gagthegirl.net with the subject line “Removal Request” and the URL(s) concerned. We handle these requests confidentially and as a priority. See our Terms of Service for details.
